Conditions General Terms and Conditions of Use
1. Purpose
The company Phaino, hereinafter referred to as Bon Aptea, operates a catering platform available on the website at www.bonaptea.fr or in the form of a mobile application designed to connect travelers visiting specific destinations with local individuals residing in the heart of these destinations, enabling them to experience new culinary flavors and share their culture over a meal.
These general terms and conditions of use aim to govern access to and the methods of using said platform. We invite you to read them carefully. You understand and acknowledge that Bon Aptea is not a party to any agreement, contract, or contractual relationship of any kind entered into between the members of its platform or with a restaurateur.
By clicking on the "Login with Facebook" or "Register by email" button, you acknowledge that you have read and accept all of these general terms and conditions of use.
2. Definitions
In these terms, the following terms are defined as follows:
- Bon Aptea: has the meaning given in Article 1 above.
- Menu Card: a menu card concerning meals posted on the platform by a restaurateur.
- CGU: these general terms and conditions of use.
- Account: the account that must be created to become a member and access certain services offered by the platform.
- Facebook Account: has the meaning given in Article 3.2 below.
- Booking Confirmation: has the meaning given in Article 4.2.1 below.
- Member Content: has the meaning given in Article 11.2 below.
- Guest: a member who has accepted the offer to be hosted by the restaurateur or, where applicable, the person for whom a member has reserved a meal.
- Member: any individual who has created an account on the platform.
- Platform: has the meaning given in Article 1 above.
- Price: the all-inclusive price requested by the restaurateur and accepted by the guest for a meal at the restaurateur’s home, chosen from their menu.
- Reservation: has the meaning given in Article 4.2.1 below.
- Restaurateur: a member offering, via the platform, a meal at their home to another individual and their companions, for a given amount, based on a menu defined solely by them.
- Meal: refers interchangeably to breakfast, brunch, afternoon tea, main meal, or festive meal.
- Services: all services provided by Bon Aptea through the platform.
- Site: the website accessible at www.bonaptea.fr.
- Summary Voucher: a voucher detailing the total price to be paid, including all taxes, and the order details.
3. Registration on the Platform and Account Creation
3.1 Conditions for Platform Registration
Use of the platform is reserved for individuals aged 18 or older. Any registration on the platform by a minor is strictly prohibited. By accessing, using, or registering on the platform, you declare and warrant that you are 18 years or older or, at the very least, accessing the site under parental or legal guardian supervision.
3.2 Account Creation
The platform allows members to post menu cards, view menu cards, and interact with each other to reserve a meal. You can view menu cards even if you are not registered on the platform. However, you cannot post a menu card or reserve a meal without first creating an account and becoming a member.
To create your account, you can:
- Fill in all the mandatory fields on the registration form; or
- Log in, via our platform, to your Facebook account (hereinafter, your "Facebook Account"). By using this feature, you understand that Bon Aptea will access, publish on the platform, and retain certain information from your Facebook Account. You can unlink your account and your Facebook Account at any time via the "profile" section. To learn more about the use of your data in connection with your Facebook Account, please consult our Privacy Policy and that of Facebook.
To register on the platform, you must have read and accepted these CGU as well as the Privacy Policy.
When creating your account, regardless of the chosen method, you agree to provide accurate and truthful personal information and to update it through your profile or by notifying Bon Aptea to ensure its relevance and accuracy throughout your contractual relationship with Bon Aptea.
If registering by email, you agree to keep the chosen password confidential and not disclose it to anyone. In case of loss or disclosure of your password, you agree to inform Bon Aptea immediately. You are solely responsible for the use of your account by a third party until you have expressly notified Bon Aptea of the loss, fraudulent use by a third party, or disclosure of your password to a third party.
You agree not to create or use, under your own identity or that of a third party, any accounts other than the one initially created.
3.3 Verification
Bon Aptea may, for transparency, trust-building, or fraud prevention or detection purposes, implement a verification system for certain information provided in your profile. This is particularly the case when you provide your phone number or an identity document.
You acknowledge and accept that any reference on the platform or services to information described as "verified" or similar terms only means that a member has successfully completed the verification procedure on the platform or services to provide you with more information about the member you plan to dine with. Bon Aptea does not guarantee the truthfulness, reliability, or validity of the information subject to the verification procedure.
4. Use of Services
4.1 Posting Menu Cards
As a member, and provided you meet the conditions below, you can create and publish menu cards on the platform by providing information about the meals you plan to offer (number of guests accepted, type of meal, meal description, options offered, meal and drink prices, etc.).
You are only authorized to publish a menu card if you meet all of the following conditions:
- You only offer catering in residences you own or use with the express permission of the owner, and in all cases, are authorized to use for catering purposes;
- You are and remain the primary restaurateur of the menu offered, as listed in the menu card;
- You agree to comply with the necessary hygiene standards to ensure the health of each guest;
- You agree to use fresh, high-quality, non-expired products.
You acknowledge that you are solely responsible for the content of the menu card you publish on the platform. Consequently, you declare and warrant the accuracy and truthfulness of all information contained in your menu card and agree to provide the meal according to the terms described in your menu card.
Your menu card will be published on the platform and thus visible to members and all visitors, even non-members, searching on the platform. Bon Aptea reserves the right, at its sole discretion and without notice, not to publish or to remove, at any time, any menu card that does not comply with the CGU or that it deems harmful to its image, that of the platform, or that of the services.
4.2 Meal Reservation
Bon Aptea has implemented an online meal reservation system through the menu cards offered on the platform.
4.2.1 Meals at the Restaurateur’s Home
When a guest is interested in a restaurateur’s menu card, they can make an online reservation request. This reservation request is manually accepted by the restaurateur. At the time of booking, the guest makes an online payment for the amount shown on their summary voucher. After payment verification by Bon Aptea and validation of the reservation request by the restaurateur, the guest receives a booking confirmation.
Upon booking confirmation, Bon Aptea provides you with the contact details (electronic and/or telephone) of the restaurateur (if you are a guest) or the guest (if you are a restaurateur), provided the member has consented to the disclosure of their phone number. You are now solely responsible for executing the contract binding you to the other member.
4.2.2 Personal Nature of Meal Reservations and Terms of Use of Services on Behalf of a Third Party
Any use of the services, whether as a restaurateur or a guest, is personal. Both the restaurateur and the guest must correspond to the identity provided to Bon Aptea and to the other members participating in the meal, where applicable.
However, Bon Aptea allows its members to reserve one or more meals on behalf of a third party. In this case, you agree to accurately provide the restaurateur, at the time of booking, with the first name, age, and phone number of the person for whom you are reserving a meal. It is strictly prohibited to reserve a meal for an unaccompanied minor under 12 years of age. If you reserve a meal at a restaurateur’s home for an unaccompanied minor under 12 years of age, you agree to obtain the restaurateur’s prior consent and provide them with a duly completed and signed authorization from the legal guardians.
Furthermore, the platform is intended for meal reservations for individuals. It is therefore prohibited to reserve a meal for an animal.
Additionally, it is prohibited to publish a menu card for a restaurateur other than yourself.
4.3 Review System
4.3.1 Operation
Bon Aptea encourages you to leave a review about a restaurateur (if you are a guest) or a guest (if you are a restaurateur) with whom you have shared a meal or were supposed to share a meal. However, you are not authorized to leave a review about a member with whom you have not dined or were not supposed to dine.
4.3.2 Moderation
You acknowledge and accept that Bon Aptea reserves the right not to publish or to delete any review, question, comment, or response whose content it deems contrary to these CGU.
4.3.3 Threshold
Bon Aptea reserves the right to suspend your account, limit your access to the services, or terminate these CGU if you have received at least three reviews and the average of the reviews you have received is equal to or less than 3.
5. Financial Conditions
Access and registration on the platform, as well as searching, viewing, and publishing menu cards, are free. However, reservations are subject to payment as described below.
5.1 Prices
For a meal at your home, the amount is determined by you, as the restaurateur, under your sole responsibility.
When you publish a menu card, you are invited to set an adult price and a child price for each meal offered. It is your responsibility to adjust it upward or downward to account for the actual costs you incur over time.
5.2 Service Fees
For meals, Bon Aptea charges, in exchange for the use of the platform, service fees calculated based on the total price of the summary voucher at the time of booking. These service fees amount to 15% of the total amount paid by the guest.
The restaurateur is therefore invited to take these service fees into account when setting their meal prices.
5.3 Rounding
You acknowledge and accept that Bon Aptea may, at its sole discretion, round service fees and prices up or down.
5.4 Payment and Price Transfer Terms
5.4.1 Collection Mandate
By using the platform as a restaurateur, you entrust Bon Aptea with a mandate to collect, in your name and on your behalf, the amounts you have set for your meals when they are booked and paid for by a guest.
Therefore, for a meal at your home, and after manual acceptance of the reservation, Bon Aptea collects the full amount paid by the guest (service fees and meal prices).
The meal prices received by Bon Aptea are deposited into a dedicated account for guest payments.
You acknowledge and accept that none of the amounts collected by Bon Aptea on behalf of the restaurateur accrue interest. You agree to respond promptly to any request from Bon Aptea and, more generally, from any competent administrative or judicial authority, particularly regarding anti-money laundering measures. In particular, you agree to provide, upon simple request, any proof of address and/or identity documents as needed.
In the absence of a response to these requests, Bon Aptea may take any measures it deems appropriate, including freezing the amounts paid and/or suspending your account and/or terminating these CGU.
5.4.2 Transfer of the Price to the Restaurateur
Following a meal at the restaurateur’s home, guests have 24 hours to file a complaint with Bon Aptea. In the absence of a complaint within this period, Bon Aptea considers the meal confirmation as acquired.
From this express or implied confirmation, you, as a restaurateur, have a collectible credit on your account. This credit corresponds to the total amount paid by the guest at the time of booking confirmation, minus the service fees.
Once the meal at your home is confirmed by the guest, you, as a restaurateur, can instruct Bon Aptea to transfer the funds to your bank account (after providing your bank details in your account).
The transfer order in your name will be sent on the first business day following your request or, in the absence of a request, on the first business day following the availability of the funds in your profile (provided Bon Aptea has your banking information).
After the five-year statute of limitations, any unclaimed amounts will be deemed to belong to Bon Aptea.
6. Cancellation Policy
6.1 Refund Terms in Case of Cancellation
Only meals taken at a restaurateur’s home are subject to this cancellation policy. Bon Aptea offers no guarantee of any kind in case of cancellation, for any reason.
Cancellation of a meal at a restaurateur’s home by the restaurateur or the guest after booking confirmation is subject to the following provisions:
- In case of cancellation attributable to the restaurateur, the guest is refunded the full amount paid. This applies, in particular, when the restaurateur cancels a meal or fails to welcome the guest within 15 minutes of the agreed time;

In case of cancellation attributable to the guest:
- If the guest cancels more than 36 hours before the appointment time, the guest is refunded the full amount paid, minus the 15% service fees, which remain acquired by Bon Aptea, and the restaurateur receives no payment of any kind;
- If the guest cancels less than 36 hours but more than 24 hours before the appointment time, the guest is refunded half of the total amount paid, minus the 15% service fees, which remain acquired by Bon Aptea. The restaurateur receives 50% of the total amount paid, minus the 15% service fees, which remain acquired by Bon Aptea (as it is assumed the restaurateur may have already incurred costs, such as purchasing ingredients before the appointment day);
- If the guest cancels 24 hours or less before the scheduled appointment time or fails to show up at the meeting place within 15 minutes of the agreed time, no refund is provided. The restaurateur is compensated with the full amount paid, minus the 15% service fees, which remain acquired by Bon Aptea.
When cancellation occurs before the appointment time and is due to the guest, the place(s) canceled by the guest for the meal are automatically made available for other guests to book online, subject to these CGU.
Bon Aptea, at its sole discretion and based on the information available, assesses the legitimacy of refund requests it receives.
6.2 Right of Withdrawal
By accepting these CGU, you expressly agree that the contract between you and Bon Aptea, consisting of connecting you with another member, is executed before the expiration of the withdrawal period upon booking confirmation, and you expressly waive your right of withdrawal.
7. Behavior of Platform Users and Members
7.1 Commitment of All Platform Users
You acknowledge that you are solely responsible for complying with all laws, regulations, and obligations applicable to your use of the platform.
Furthermore, when using the platform and during meals, you agree to:
- Not provide Bon Aptea (particularly when creating or updating your account) or other members with any false, misleading, or fraudulent information;
- Not make statements, behave in a manner, or publish content on the platform that is defamatory, abusive, obscene, pornographic, vulgar, offensive, aggressive, inappropriate, violent, threatening, harassing, racist, xenophobic, sexually suggestive, inciting hatred, violence, discrimination, encouraging illegal activities or the use of illegal substances, or, more generally, contrary to the platform’s purposes, likely to infringe on Bon Aptea’s or a third party’s rights, or contrary to good morals;
- Not infringe on Bon Aptea’s rights and image, particularly its intellectual property rights;
- Not open more than one account on the platform or open an account in the name of a third party;
- Not attempt to bypass the platform’s online booking system, particularly by trying to share your contact details with another member to make a reservation outside the platform and avoid paying the 15% service fees;
- Not contact another member, particularly via the platform, for any purpose other than arranging the terms of home catering;
- Not accept or make payments outside the platform;
- Comply with these CGU and the Privacy Policy.
7.2 Commitment of Restaurateurs
In addition, when using the platform as a restaurateur, you agree to:
- Comply with all laws, regulations, and codes applicable to the residence in your country, including holding the required insurance at the time of the meal (e.g., fire, liability, and/or other insurance, where applicable);
- Provide Bon Aptea or any restaurateur who requests it with your identity card or any document proving your identity;
- Ensure that your insurance covers guests and that they are therefore covered by your insurance;
- Not take any risks while cooking and serving your guests, and not consume any substances that could impair your attention and ability to safely host guests;
- Publish menu cards corresponding only to meals that can actually be prepared;
- Provide the meal as described in the menu card (particularly regarding ingredients and the nature of the food) and respect the agreed times and locations with other members (particularly the meeting place);
- Not accept more guests than the number of places available in your residence;
- Use fresh products that comply with required hygiene standards, including using clean kitchen equipment and washing your hands properly;
- In case of unavailability or changes to the schedule or meal, inform your guests without delay;
- Wait for guests at the agreed meeting place for at least 15 minutes beyond the agreed time;
- Not publish photos of a meal location related to a residence you do not own or are not authorized to use for catering purposes;
- Ensure you are reachable by phone by your guests at the number registered in your profile;
- Maintain appropriate and responsible behavior during the meal, consistent with the spirit of a "family" group meal.
7.3 Commitment of Guests
When using the platform as a guest for a meal at a restaurateur’s home, you agree to:
- Adopt appropriate and responsible behavior during the meal, consistent with the spirit of a "family" group meal, so as not to disturb other guests;
- Respect the restaurateur’s residence and its cleanliness;
- Not steal, destroy, damage, or deliberately break anything;
- In case of unavailability, inform the restaurateur without delay;
- Wait for the restaurateur at the agreed meeting place for at least 15 minutes beyond the agreed time;
- Provide Bon Aptea or any restaurateur who requests it with your identity card or any document proving your identity;
- Not bring to a meal at a restaurateur’s home any object, merchandise, substance, or animal that could disturb the restaurateur or whose nature or possession is contrary to applicable legal provisions;
- Ensure you are reachable by phone by the restaurateur at the number registered in your profile.
If you have reserved one or more places on behalf of third parties, in accordance with Article 4.2.3 above, you vouch for the third party’s compliance with the provisions of this article and, more generally, these CGU. Bon Aptea reserves the right to suspend your account, limit your access to the services, or terminate these CGU in case of a breach by the third party for whom you reserved a place.
8. Account Suspension, Access Limitation, and Termination
You may terminate your contractual relationship with Bon Aptea at any time, without cost or reason. To do so, simply go to your profile page and click the "I want to delete my Bon Aptea account" button.
In case of a violation of these CGU, particularly your obligations as a member outlined in Article 7 above, exceeding the threshold specified in Article 4.3.3 above, or if Bon Aptea has serious reasons to believe this is necessary to protect its security and integrity, that of its members or third parties, or for fraud prevention or investigation purposes, Bon Aptea reserves the right to:

Terminate these CGU immediately and without notice;and/or

Prevent the publication or delete any reviews, menu cards, messages, content, reservation requests, or any content published by you on the platform;and/or
-
Limit your access and use of the platform;and/or
- Suspend your account temporarily or permanently.
When necessary, you will be notified of the implementation of such measures to allow you to provide explanations to Bon Aptea. Bon Aptea will decide, at its sole discretion, whether to lift the measures or not.
9. Personal Data
In the context of your use of the platform, Bon Aptea collects and processes some of your personal data. By using the platform and registering as a member, you acknowledge and accept the processing of your personal data by Bon Aptea in accordance with applicable law and the provisions of the Privacy Policy.
In accordance with Law No. 09-08 promulgated by Dahir 1-09-15 of February 18, 2009, regarding the protection of individuals with regard to the processing of personal data, you have the right to access, information, rectification, and opposition to the information concerning you, which you can exercise by contacting us via this contact form.
10. Intellectual Property
10.1 Content Published by Bon Aptea
Subject to content provided by its members, Bon Aptea is the sole holder of all intellectual property rights related to the service, the platform, its content (including texts, images, designs, logos, videos, sounds, data, graphics), as well as the software and databases ensuring their operation.
Bon Aptea grants you a non-exclusive, personal, and non-transferable license to use the platform and services for your personal and private use, on a non-commercial basis and in accordance with the platform’s and services’ purposes.
You are prohibited from any other use or exploitation of the platform, services, and their content without Bon Aptea’s prior written authorization. In particular, you are prohibited from:
- Reproducing, modifying, adapting, distributing, publicly performing, or disseminating the platform, services, and their content, except as expressly authorized by Bon Aptea;
- Decompiling or reverse-engineering the platform or services, subject to exceptions provided by applicable laws;
- Extracting or attempting to extract (particularly using data scraping robots or similar data collection tools) a substantial part of the platform’s data.
10.2 Content Published by You on the Platform
To enable the provision of services and in accordance with the platform’s purpose, you grant Bon Aptea a non-exclusive license to use the content and data you provide as part of your use of the services (hereinafter, your "Member Content"). To allow Bon Aptea to distribute via digital networks and according to any communication protocol (particularly the Internet and mobile networks) and to make the platform’s content available to the public, you authorize Bon Aptea, worldwide and for the entire duration of your contractual relationship with Bon Aptea, to reproduce, represent, adapt, and translate your Member Content as follows:
- You authorize Bon Aptea to reproduce all or part of your Member Content on any digital recording medium, known or unknown to date, particularly on any server, hard drive, memory card, or other equivalent medium, in any format and by any process known or unknown to date, to the extent necessary for any storage, backup, transmission, or download operation related to the platform’s operation and service provision;
- You authorize Bon Aptea to adapt and translate your Member Content, as well as to reproduce these adaptations on any current or future digital medium as specified in point a above, to provide the services, particularly in different languages. This right includes the ability to make, in compliance with your moral rights, modifications to the formatting of your Member Content to adhere to the platform’s graphic charter and/or make it technically compatible for publication via the platform.
10.3 Photos published on the platform
Through the Bon Aptea platform, you are given the possibility to keep photos in your memory album. All photographs published on its platform may be used for Bon Aptea’s communication (featured on the homepage, on its social networks or elsewhere). Photos of naked persons or not respectful of morality are prohibited. Bon Aptea reserves the right to delete any photos that the company deems non-compliant with its values.
11. Role of Bon Aptea
The platform is an online matchmaking platform where members can create and publish menu cards to offer home catering. These menu cards can be viewed by other members to learn about the meal’s terms and, if applicable, directly reserve a place with the member who posted the menu card on the platform.
By using the platform and accepting these CGU, you acknowledge that Bon Aptea is not a party to any agreement entered into between you and other members to cover the costs related to a meal.
Bon Aptea has no control over the behavior of its members or platform users. It does not own, operate, provide, or manage the meals listed in the menu cards, nor does it offer any meals on the platform.
You acknowledge and accept that Bon Aptea does not control the validity, truthfulness, or legality of the menu cards, places, or meals offered. As a catering intermediary, Bon Aptea does not provide any catering services and does not act as a restaurateur; its role is limited to facilitating access to the platform.
For meals at the restaurateur’s home, members (restaurateurs or guests) act under their sole and full responsibility.
As an intermediary, Bon Aptea cannot be held liable for the actual execution of a meal, particularly due to:
- Incorrect information provided by the restaurateur in their menu card or by any other means regarding the meal and its terms;
- Cancellation or modification of a meal by a member;
- The behavior of its members before, during, or after the meal.
12. Platform Operation, Availability, and Features
Bon Aptea will endeavor, as far as possible, to keep the platform accessible 7 days a week and 24 hours a day. However, access to the platform may be temporarily suspended without notice due to technical maintenance operations, migrations, updates, or issues related to network operations.
Furthermore, Bon Aptea reserves the right to modify or interrupt, at its sole discretion, temporarily or permanently, all or part of the access to the platform or its features.
13. Modification of the CGU
These CGU and the documents incorporated by reference constitute the entire agreement between you and Bon Aptea regarding your use of the services. Any other document, particularly any mention on the platform (FAQ, etc.), is for informational purposes only.
Bon Aptea may modify these general terms and conditions of use to adapt to its technological and commercial environment and to comply with applicable regulations. Any changes to these CGU will be published on the platform with an indication of the update date and will be notified to you by Bon Aptea before they take effect.
14. Applicable Law – Disputes
These CGU are written in French and subject to Moroccan law.
In case of a dispute regarding the validity or interpretation of these general terms and conditions, the parties will endeavor to resolve their dispute amicably.
In the absence of such amicable resolution within thirty (30) days from the notification made by the more diligent party to the other party, and in case of a dispute between the restaurateur and the guest, and notwithstanding any contrary condition, the competent jurisdiction is the court of the restaurateur’s domicile or place of residence or the court of the place where the event causing the harm occurred.
15. Legal Notices
The platform is operated by the company Phaino, registered with the Commercial Register under number 107 797 (professional tax number: 25100065 and tax identification number: 3372405), with its registered office located at 24, Avenue de France, Apt 9, 3rd floor, Agdal, Rabat (Email: contact@phaino.ca), represented by its General Manager Amine El Moutaouakil.
